CHRISTMAS TREES, CACTI, AND YUCCA NATIVE TO NEVADA
(26 February 2008)

As of the date above, the native cacti, yucca, and evergreen trees listed below are protected and regulated by Nevada Revised Statutes (N.R.S.) 527.060-.120 and Nevada Administrative Code chapter 527 when proposed for removal or possession at "commercial" rates or quantities (see below). Such removal or possession requires a permit and tags from the Nevada State Forester Firewarden, Nevada Division of Forestry. CAUTION: Some of the species below are protected by additional laws and regulations. See the At-risk Plant and Lichen Tracking List and List of State-listed Plants for further information. Changes since 26 February 2008 are shown in the same color as this sentence.

The removal or possession of Christmas trees, cacti or yucca for commercial purposes means the removal or possession of six or more of such plants in any 1 calendar day or the removal or possession of less than six of such plants each for 7 or more consecutive calendar days, except removal or possession of the plants for scientific or educational purposes with the permission of the owner of the plants (NRS 527.071).

Christmas trees, cacti or yucca which are removed or possessed for commercial purposes in Nevada and which are to be transported . . . must be accompanied by a shipping permit issued by the state forester firewarden, or his duly authorized agent (NRS 527.081). All Christmas trees, cacti or yucca removed or possessed for commercial purposes must have attached thereto a tag issued by the state forester firewarden, by the Bureau of Land Management or by the United States Forest Service (NRS 527.091).

It is unlawful . . . to cut, destroy, mutilate, remove or possess any Christmas tree, cactus, yucca or branches thereof, or knowingly transport or sell any [of same] from any of the lands owned by or under the jurisdiction of the State of Nevada or its counties, or on any reserved or unreserved lands owned by the United States, or from any privately owned lands, without written permission from the legal owner, or his duly authorized agent, specifying locality by legal land description and number of plants to be removed or possessed (NRS 527.101).
